No kidding. Honestly I can't say I'm optimistic about your chances. I wish I could, and believe me, the only thing I would like more than a favorable verdict is a favorable countersuit. It is my strong desire that, should you (or someone down the road) prevail, that victory would be turned into a class action countersuit against the MAFIAA for all the pain they have caused and lives they have destroyed (not to mention legal bills incurred). (And in the worst case, I'd love to see artists start suing the RIAA for their share of these outrageous "damages" they keep extorting.
