I hope you slam dunk this case so the RIAA stops their tyranny within the USA. The courts are so scared of this organization and it is ridiculous. And any judges reading this…. You need to get a clue about technology and how that intersects the law before making decisions on who is guilty and who is not. You need to ask yourself how does the RIAA have the information and IP addresses of people’s computer without accessing those computers? How do they know which files were successfully downloaded without accessing someone’s computer? By accessing someone computer without authorization the RIAA is breaking every law in the book and they are not getting prosecuted for it — EVER. In any other court case outside of music, the RIAA would be brought up on charges. You can not break the law to apprehend others that may or may not be breaking the law.

If you are a student run time, the first thing you should have done in this case is to read/memorize the FRCP, the court’s local rules, the judge’s local rules, if any, and your state’s ethics rules.
